What is employers' liability insurance?

Employers' liability insurance provides employers with additional coverage for costs associated with work-related injuries or diseases suffered by employees beyond what’s covered by workers' compensation law.

What's covered in employers' liability insurance?

  • You’re covered if an employee is injured by a product you make so you are now also liable as a manufacturer.

  • You’re covered if a harmed employee’s spouse who suffers related losses files a lawsuit.​

  • You’re covered if an employee gets workers' compensation benefits but also sues a third party, and due to a contract between you and the third party, the liability is passed back to you.

What's not covered in employers' liability insurance?

  • Punitive damages due to the injury of a person illegally employed.

  • Non-physical injuries (e.g., defamation)

What is an Experience Modification Rate (EMR)?

EMR is a measure that different carriers use to calculate the premium by applying incurred loss experiences and comparing it to average losses of similarly classified businesses. The lower the EMR, the lower the workers’ compensation premium will be. The EMR takes into consideration the number of claims/injuries a company has had in the past along with other corresponding costs.

NB: Final price may vary based on additional information provided. Premium estimates expire after 30 days. The effective date of your coverage cannot be before receipt of payment.
